Why Was the SOA Put into Place?
The SOA was introduced by the Centers for Medicare & Medicaid Services (CMS) to protect Medicare beneficiaries from unsolicited sales tactics and ensure transparency in the enrollment process. It ensures that clients have control over the scope of the discussion and aren’t pressured into purchasing products they didn’t plan to consider. This regulation helps prevent any "bait-and-switch" tactics by limiting the conversation to only the topics explicitly agreed upon.
How Clients Use the SOA
Before any meeting, whether it’s in person or over the phone, clients must complete and sign an SOA form, which details the products they want to discuss, such as Medicare Advantage, Part D prescription drug plans, or Medigap policies. The form needs to be signed 48 hours prior to the appointment, unless the meeting is scheduled within that timeframe. Clients can update the SOA if they wish to explore additional Medicare products beyond the initial discussion topics. This step ensures that clients maintain control of the conversation and feel empowered throughout the process.
